They must monitor carefully at all unusual transactions to see if there is anything suspicious<br \/>\nabout the customer.<br \/>\nThere are many reasons why an employee might become suspicious about a transaction\/activity. Often it is just because of<br \/>\nsomething unusual for a business, maybe a customer behaved strangely, or perhaps customer made unusual requests that did<br \/>\nnot seem to make sense.<br \/>\nThe Company\u2019s employees may be guided by the examples provided in the Company\u2019s internal measures for \u201cMechanism or Red<br \/>\nFlag to indicate occurrence of suspicious transaction\u201d, to assist them in identifying any attempted or proposed suspicious<br \/>\ntransaction.<br \/>\nEVALUATING AND INVESTIGATING<br \/>\nWhenever a Company\u2019s employee detects any \u201cred flag\u201d that fits the list indicated above or senses any unusual<br \/>\nactivity\/transaction, he\/she must directly inform the AML Designated Compliance Officer (\u201cDCO\u201d) without delay.<br \/>\nUpon receiving any internal STR from the Company\u2019s employees, the DCO will first evaluate the grounds for suspicion and he will<br \/>\nmake an initial decision of whether a customer\/transaction is potentially suspicious.<br \/>\nThe employee may be required to investigate the Customer\/transaction further under the direction of the DCO. This may include<br \/>\ngathering additional information from the customer or from third party sources to assist in determining whether the<br \/>\ncustomer\/transaction is indeed suspicious and to eliminate \u201cfalse positive\u201d.<br \/>\nThese procedures should reflect the principle of confidentiality, where employees are to ensure that investigation is conducted<br \/>\nswiftly and that reports contain relevant information and are produced and submitted to the DCO in a secured and confidential<br \/>\nmanner, within five (5) working days from the commencement of investigation.<br \/>\nREPORTING<br \/>\nInternal Suspicious Transaction Report (\u201cSTR\u201d) prepared by the Company\u2019s employee must be reviewed by the DCO within three<br \/>\n(3) working days from receiving such report.<br \/>\nThe DCO is to complete his\/her review within five (5) working days. Under the circumstances where a report requires further<br \/>\ninvestigation, the timeframe can be exceeded up to a month.<br \/>\nOnce the DCO has finished review of the details, he\/she should determine if that particular event rendered an attempted or<br \/>\nproposed suspicious transaction.<\/p>\n<p>GLOBAL CAPITAL MARKET LIMITED<br \/>\nThe DCO will consult with the Company\u2019s Board of Directors to make the decision as to whether the customer\/transaction is<br \/>\nsuspicious and whether a filing to the Authority(ies) is necessary.<br \/>\nDCO shall submit the STR using the specified reporting template, to both of the following authorities:<br \/>\nDirector<br \/>\nFinancial Intelligence and Enforcement Department<br \/>\nBank Negara Malaysia<br \/>\nJalan Dato\u2019 Onn<br \/>\n50480 Kuala Lumpur, Malaysia<br \/>\n(To be opened by addressee only) Fax: +603-2691 6108<br \/>\nE-mail: str@bnm.gov.my; AND<br \/>\nHead, AML Policy Unit<br \/>\nPolicy and Digital Technology Department Labuan Financial Services Authority<br \/>\nLevel 17, Main Office Tower<br \/>\nFinancial Park Complex, Jalan Merdeka<br \/>\n87000 Federal Territory of Labuan, Malaysia<br \/>\n(To be opened by addressee only)<br \/>\nFax: +603-8873 2209<br \/>\nE-mail: aml@labuanfsa.gov.my<br \/>\nThe DCO will inform the Company\u2019s Board of Directors of any report submitted. In the case of a filed report, a backup documentation is necessary.<br \/>\nThe following are some of the information maintained for record keeping, which includes but is not limited to:<br \/>\ni.<br \/>\nii.<br \/>\niii.<br \/>\nMaintain a record of identifying information provided by the Customer.<br \/>\nWhere the Company relies upon a document to verify identity, the Company must maintain a copy of the document with<br \/>\nclear evidence that the Company relied on and any identifying information it may contain.<br \/>\nRecord the methods and result of any additional measures undertaken to verify the identity of the Customer.<br \/>\niv. Record the resolution of any discrepancy in the identifying information obtained.<br \/>\nv. The nature or circumstances surrounding the transaction; and<br \/>\nvi.
